Terms and Conditions (Alan Commerce e.K.)

Effective: May 2025


1. Scope of Application

(1) These terms and conditions (T&Cs) apply to all contracts between Alan Commerce e.K., Waller Heerstraße 236, 28219 Bremen, Germany, email: alancommerce@outlook.com (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer" or "Consumer") for the purchase and delivery of goods via the online shops www.carjoker.de and www.carjoker.com.

(2) These T&Cs apply to orders from customers in Germany, the EU, and internationally, unless otherwise agreed.

(3) The contract language is German. For customers outside Germany, a translation may be provided. In case of disputes, the German version shall prevail.


2. Contract Conclusion

(1) The product displays in the online shop do not represent legally binding offers, but non-binding invitations to place orders.

(2) By placing an order, the customer submits a binding purchase offer.

(3) The purchase contract is concluded when the seller accepts the order by sending an order confirmation via email.

(4) If a product is unavailable, the seller will inform the customer promptly and refund any payments already made.


3. Prices & Payment Terms

(1) All prices are total prices including statutory VAT (where applicable).

(2) For deliveries within the EU, VAT is calculated and paid in accordance with applicable OSS regulations.

(3) For deliveries outside the EU, additional duties, taxes, or import charges may apply, which are the responsibility of the customer.

(4) Customers can choose from the payment methods listed in the shop (e.g. PayPal, credit card, Klarna, bank transfer).

(5) Payment is due immediately after conclusion of the contract. Shipping takes place only after full payment has been received.


4. Shipping & Delivery

(1) Delivery times are generally 2–7 business days, depending on the delivery address and shipping provider.

(2) The goods are shipped to the address provided by the customer. The customer is responsible for ensuring that the delivery address is accurate.

(3) Delivery times outside the EU may be extended due to customs processing.

(4) If incorrect address data is provided and the shipment cannot be delivered, the customer bears the cost of re-delivery.


5. Right of Withdrawal & Returns

(1) Customers with a delivery address within the EU have a statutory right of withdrawal of 14 days. The full withdrawal policy is available at https://www.carjoker.com/pages/widerrufsbelehrung.

(2) Customers outside the EU may only return goods in accordance with national laws or after prior agreement with the seller.

(3) The customer bears the return shipping costs and must provide the seller with a tracking number.

(4) Returns from non-EU countries must be properly declared to avoid delays and additional customs charges.


6. Warranty & Liability

(1) The statutory warranty period of 24 months applies to consumers within the EU.

(2) Damages caused by improper use, normal wear and tear, or unauthorized repairs are excluded from the warranty.

(3) The seller is liable only for intent and gross negligence. In the case of essential contractual obligations, liability also applies to slight negligence.

(4) For international orders, the national consumer protection laws of the delivery country apply.


7. Retention of Title

(1) Goods remain the property of the seller until full payment has been made.

(2) In the event of payment default, the seller is entitled to reclaim the goods.


8. Customs, Taxes & Import Charges (International Orders)

(1) Customers outside the EU are responsible for any applicable customs duties, taxes, or fees.

(2) The seller assumes no liability for customs delays or additional charges.

(3) If the customer refuses acceptance and the parcel is returned, the customer bears all resulting costs.


9. Data Protection

(1) The processing of personal data is carried out in accordance with applicable data protection laws. The privacy policy is available at https://www.carjoker.com/pages/datenschutz.

(2) Customer data will only be disclosed to third parties insofar as this is necessary for the performance of the contract.


10. Contract Language & Applicable Law

(1) The contract language is German. In case of doubt, the German version shall apply.

(2) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of other countries remain unaffected.


11. Online Dispute Resolution (ODR Platform)

The European Commission provides a platform for online dispute resolution:

We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.


12. Final Provisions

(1) Should any provision of these terms be or become invalid, the remaining provisions shall remain unaffected.

(2) Amendments and supplements to these terms require written form.
